This Privacy Policy (“Policy”) explains how Batesville Services, LLC and its subsidiaries and affiliates (“Batesville,” “we,” “our” or “us”), may collect, use, and disclose your personal information; the choices you have regarding our use of your personal information; and how to contact us regarding our privacy practices.

This Policy applies to personal information we obtain about you through www.batesville.com including our Batesville Connect site accessible with a username and password by representatives of our funeral home customers (“Funeral Professionals”) with registered accounts for purchasing products and services, or through www.remembrancestore.com (collectively the “Site”), and personal information we collect about you offline, including but not limited to, personal information that we receive from Funeral Professionals (collectively, the “Services”).

This Policy DOES NOT apply to information that we collect through Batesville Technology products and services, including but not limited to, Batesville hosted websites for Funeral Professional Customers and related e-commerce services.

Please read this Policy carefully to understand our policies and practices regarding your personal information. By using our Services, you are consenting to the practices described in this Policy. If you do not agree with our policies and practices, please do not use our Services or provide us with your personal information. Use of Batesville Connect by Funeral Professionals is also subject to our Terms of Service.

What Personal Information We Collect

We may collect personal information directly from you or automatically through your use of the Site; we also may obtain personal information through Funeral Professionals’ use of our products and services.

“Personal information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household, such as your name, email address, IP address, telephone number, credit card number, and certain details about your internet activity. 

The categories of personal information we collect about you depend on how you interact with us and may include the following:

Direct Identifiers, such as name, email address, postal address, signature, and account details.
Personal Records, such as phone number, photographs, bank account information, payment card information, and related information to process payments and orders.
Personal Characteristics or Traits (including characteristics of protected classifications), such as those provided for product and service personalization, or for our Living Memorial program and products, which may include age, gender, marital status, military or veteran status, disability, professional or trade associations, or religion/religious beliefs.
Commercial Information, such as records of products or services purchased, purchasing tendencies, records of products or services considered, and information provided in connection with orders.
Professional Information, such as Funeral Professional or other company affiliation, job title, or profession type.
Internet or other Electronic Network Activity Information and Geolocation Information, such as IP address, device location, website browsing activity, browser type, device identifier, operating system, accessibility features utilized, and Site pages and webpage features visited.
Inferences from Personal Information Collected, such as product and/or purchase preferences, Site user and Batesville Connect user preferences, and burial and cremation preferences.
Product Design and Personalization Information, such as information provided by you for personalization of a product for you or a loved one that is submitted through your Funeral Professional, such as names, date of birth, family relationship, images/photographs, and information to be imprinted on a product or used in providing a service, including fingerprints or handwriting.
Other Personal Information, including information you provide when you contact us, seek our assistance purchasing products or services, respond to a satisfaction survey, or make comments or suggestions; information we obtain when you attend our professional trainings and seminars, when a person sends you a gift (e.g., Living Memorial), or when you interact with us on social media; or information regarding your family relationships.

Some forms on our Site may require you to provide personal information to submit the form. You may choose not to provide personal information in those cases, but this may prevent you from being able to use certain features of our Site.

How We Use Personal Information

We may use your personal information to:

Provide products and services, including for permitting you to select and personalize products such as through our digital showroom tool or Remembrance Store; processing transactions and payments; fulfilling product and service purchase orders; creating and administering accounts; administering and maintaining the Living Memorial programs; hosting events; providing professional training and seminars; and providing technology or product demonstrations.
Communicate, including responding to messages; communicating about our products and services or orders, including products and services purchased through a Funeral Professional; providing customer service; understanding preferences; and sending promotional messages and advertisements about our products and services or events.
Improve our Site and Service offerings, including understanding who is visiting our Site; analyzing how our Site is being accessed and used; improving the functionality and accessibility of our Site; conducting research and developing new products and services; and understanding satisfaction with our products and services.
Personalize our product and service offerings, to understand preferences, make recommendations, and deliver personalized experiences and products.
Market and advertise our products and services, to promote our products and services through marketing, advertising, and sponsorships, including through advertising partners that may use tracking technologies to show personalized product and service offers and measure the effectiveness of those offers.
Operate our business, including performing business functions, such as accounting, finance, tax, regulatory compliance, litigation, information security, fraud detection and prevention, protection of our rights and property, supplier and vendor management, human resources, information technology, and improving internal operations.
Maintain the security of our Site and Services, including detecting security incidents, protecting our Services against fraudulent and illegal activity, and enforcing our terms of service.
Comply with our legal obligations and respond to legal proceedings, including establishing, exercising, and defending legal claims.

We may obtain data that is publicly available or from third-party sources, such as address verification services or third-party marketing database partners, to improve the accuracy of and add to what we know about our Funeral Professionals and prospective customers. We may combine this information with your personal information for the purposes described in this Policy.

With your consent, where required, we may contact you at the mobile phone number that you provide to us by way of direct dial calls, autodialed and prerecorded message calls, text messages and push notifications in connection with the above Purposes. You are responsible for all mobile carrier data or text message charges resulting from all communications via the mobile phone number you provide to us.

How We Disclose Personal Information

We may disclose your personal information in the following circumstances:

  • With your consent to do so or at your direction.
  • With our parent company, subsidiaries, and affiliates.
  • With vendors that perform services on our behalf, such as freight companies, logistics or shipping vendors, data analytics services, payment processors, professional/educational training providers, tree and product order fulfillment vendors, marketing and promotional material distribution vendors, and data storage and security vendors.
  • With advertising vendors that may use their own tracking technologies and our tracking technology data to show you personalized ads, to measure the effectiveness of ads, and to build or enhance their understanding of you and your interests to provide you with more relevant ads.
  • With Funeral Professionals from whom you purchased our products or services, to fulfill your orders and complete transactions.
  • If we believe such disclosure is necessary. For example,
    • to comply with relevant laws or to respond to a subpoena, warrant or court order served on us;
    • to respond to valid requests by government agencies, including law enforcement authorities.
  • If we believe your actions are inconsistent with our terms of use, user agreements, applicable terms, or policies;
    to protect the rights, property, life, health, security, or safety of Batesville, its employees, the Services, and its users or any third party; or
    for the establishment of defenses or claims in any legal action or dispute involving Batesville or any of its officers, directors, employees, agents, contractors, or partners.
    In the event we sell, transfer, or assign all or a portion of our business or assets (e.g. further to a sale, merger, consolidation, change of control, reorganization, or any other business transaction, including negotiation and due diligence of such transactions, and financing due diligence), we reserve the right to disclose any information we collect from or about you. You acknowledge that such transfers may occur and are permitted by and subject to this Policy.

Social Features

Certain functionalities on our Site permit interactions that you initiate between the Site and external services, such as social networks (“Social Features”). Examples of Social Features include features enabling you to “like” or “share” our content and features that otherwise connect the Site to a third-party service (e.g., to pull or push information to or from the Site). If you use Social Features, information you post or provide access to may be publicly displayed by the third-party service you use. Also, both Batesville and the third party may have access to certain information about you and your use of the Site and the third-party service.

Cookies and Tracking Technologies

Cookies, web beacons, and other tracking technologies (“tracking technologies”) may be used to collect information about your interactions with our Site. A cookie is a small text file that is stored on your device. We use session cookies that expire when you close your browser and persistent cookies that remain on your hard drive for an extended period of time. Our Site may contain a small graphic image called a web beacon, also known as a “clear gif,” that allows us to monitor and collect certain limited information about our users. We may use web beacons to count visitors to our web pages, monitor how our users navigate our Site, or compile aggregate statistics about our Site.

We use analytics services, such as Google Analytics, Full Story, Hotjar, and SAP’s Customer Data Cloud, that collect information to analyze your use of our Site, including how often you visit our Site, what pages you view when you visit our Site, and what other websites you visited before coming to our Site. We may analyze activity on our Site through session replay technologies to help us understand and analyze how you interact with the Site and to improve the Site. We may use the information we collect through analytics to implement marketing features such as dynamic remarketing, interest-based advertising, audience targeting, behavioral reporting, demographics and interests reporting, user segment analysis, device reporting, and display advertising. Security

Although no website, application, database, or system is completely secure or “hacker proof,” we take precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction. Remember that nothing online is 100% secure. While we use standard methods to protect login credentials and data, we cannot guarantee its absolute security. If you are a Batesville Connect User, please remember that you are responsible for safeguarding your username and password.

Links to Other Websites and Services

Our Site may contain links to other websites or services that are not controlled by us; these links are provided for your convenience and information. We are not responsible for any third party’s data collection or privacy practices, and we encourage you to review the privacy policies or notices posted on these third-party websites for further information.

International Users

If you are accessing our Services from outside the United States, please be aware that Batesville is based in the United States and the information we collect will be processed and stored on our servers in the United States. The data protection laws and regulations applicable to your personal information transferred to the United States may be different from the laws in your country of residence.

Children

This Site is not directed toward children under 13 years of age nor do we knowingly collect information from children under 13 years of age. If we become aware that we have received personal information from a person under the age of 13, we will delete it in accordance with applicable law.

Your Choices

Unsubscribe from Promotional Emails

You may unsubscribe from receiving promotional emails from us by clicking on an “unsubscribe” hyperlink contained in promotional emails we send you. Please note that even if you opt out of receiving promotional emails from us, we may continue to send you non-promotional emails.

If you no longer wish to receive text messages from us, reply STOP (or as otherwise instructed) to the text message.

Retention of Personal Information

We keep your personal information based on our business and legal needs, as described in this Policy or otherwise permitted or required by law. Generally, we maintain your personal information for as long as one of the following apply:

  • Your personal information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
  • Your personal information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the personal information was collected;
